A federal judge has blocked efforts against the federal government from continuing to enforce Title 42. Keep reading to learn more.

What Is Title 42?

Title 42 is a highly controversial policy used during the height of the COVID-19 pandemic to stop migrants from crossing the border. Over two million migrants were forced to wait on the Mexican side of the border to fend for themselves.

The law, which is a part of a larger public health and safety legislation seeks to protect the public by restricting the potential for infectious diseases that may enter the country through foreign carriers. The Trump administration used Title 42 to justify a restrictive overall immigration strategy that lowered the number of migrants granted entry into the U.S. and even led to the Remain in Mexico policy.

While Title 42 and the coronavirus pandemic were used to justify these restrictions, the Biden Administration continued to uphold the policy despite doubts that it was no longer necessary. IN fact, the Centers for Disease Control and Prevention (CDC) made a public statement in April 2022 that the law was no longer necessary now that individuals had access to rapid self-tests.

The continuation of Title 42 has remained in effect despite statements like the one from the CDC. Many immigration advocacy organizations have expressed frustration about the matter and have taken opportunities to fight back.

Missouri Takes a Side

While the overwhelming majority of people who are knowledgeable about Title 42 are making efforts to stop it from continuing, 24 states including Missouri have filed lawsuits to keep the restrictive policies in place. MO representatives have repeatedly stated their concerns about the toll an influx of migrants would take on public services and local healthcare and law enforcement. Most of the motivation behind the support for Title 42 is related to funds which in many states is limited despite bonus packages from the federal government all throughout 2020 and 2021.
