Gema Garcia joined Smith Law Offices in September 2020. She has a degree from the University of Illinois-Chicago in criminal justice and primarily works with the firm’s immigration and criminal/traffic cases. She enjoys her work with our immigration clients because of the exposure to cultural diversity she sees through our global clientele. She is bilingual in English and Spanish. In her spare time, she enjoys spending time with family.

  • Is the adoption process complicated?
    It certainly can be. There are many different types of adoption cases, including grandparent adoption, guardian adoption, newborn adoption, and step-parent adoption. We work with all types of clients to help you efficiently get through this process.
  • What factors are considered when determining custody arrangements?
    Typically the best interests of the child or children are considered the most important factor in custody agreements. It is up to the judge if one or both parents will share decision-making power and who will have physical custody. They will look at the wishes of the child, their needs, the relationship the child has with each parent if there is any history of violence or substance abuse, and other elements of the child’s everyday life.
  • How will my property be divided in a divorce?

    This is a matter we can discuss during your first consultation, but typically shared property (also known as marital property) is split up 50/50 between two spouses. A few exceptions may apply to your divorce case, depending on the circumstances, but it is best to speak with an attorney first.
